Important Notice

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT PROVISIONS REGARDING YOUR LEGAL RIGHTS AND REMEDIES, INCLUDING LIMITATIONS OF LIABILITY AND INDEMNIFICATION OBLIGATIONS.

Rosecoco Africa (the "Platform") acts solely as a **technological intermediary** and **neutral marketplace**. We facilitate connections between independent adults. We do NOT employ, represent, or agency any user of the Platform.

01 ACCEPTANCE & ELIGIBILITY

By accessing the Platform, you warrant that you are at least **18 years of age** (or the age of majority in your jurisdiction, whichever is higher). If you are under 18, you are strictly prohibited from using the Platform.

**ZERO TOLERANCE POLICY**: The use of the Platform by minors is strictly forbidden. Any account found to belong to a minor, or involving a minor in any capacity, will be permanently banned, and information may be forwarded to authorities (including NCMEC, Kenyan Police Service, or South African FPB).

02 USER CONTENT & DATA (MEDIA, CONTACTS, PII)

Global Data Disclaimer

Rosecoco Africa acts as a passive technological conduit. We do not monitor, verify, or pre-approve data uploaded by users, including but not limited to **media, phone numbers, email addresses, social media handles, or physical locations/addresses**.

  • Verification Disclaimer: We do NOT verify the authenticity, ownership, or legality of any phone numbers or physical addresses provided by users. Use of this information is strictly at your own risk.
  • Mandatory Consent: By uploading any data (images, phone numbers, location data), you represent and warrant that you hold the legal rights to such data and have obtained **explicit consent** from any third parties involved.
  • Privacy Breach & Doxxing: Users are strictly prohibited from uploading the private contact information of others without consent. The Platform is not responsible for any "doxxing" or unauthorized disclosure of PII by its users.
  • Notice and Takedown: We reserve the right to remove any content (including addresses and numbers) reported as illegal or non-consensual without prior notice.

03 USER CONDUCT & PROHIBITIONS

Users are strictly prohibited from using the Platform for:

block Human Trafficking or Forced Labor
block Distribution of Narcotics or Controlled Substances
block Harassment, Stalking, or Cyber-Bullying
block Fraud, Deception, or Identity Theft
block Solicitation of Minors
block Non-consensual Acts or Violence

04 FINANCIAL FRAUD & ANTI-SCAM POLICY

Financial Safety Warning

Rosecoco Africa will **NEVER** ask you for your password or for payment outside of our official secure channels. We strictly advise against sending money to other users.

  • Romance Scams: You acknowledge the risk of "romance scams." The Platform is not liable for any financial loss incurred if you voluntarily send money, gift cards, or cryptocurrency to another user.
  • "Transport Money" Disclaimer: We are not responsible for losses related to sending "fare" or "transport money" to other users. Such transactions are conducted at your sole risk.
  • No Financial Intermediary: The Platform is not a financial institution and does not mediate disputes regarding user-to-user financial transactions.

05 OFFLINE SAFETY & "PREMISES LIABILITY"

Safety Warning

Connections made on the Platform may lead to offline, in-person meetings. You understand and agree that you are solely responsible for your safety during any offline interactions.

  • Assumption of Risk: You assume all risks associated with offline meetings, including but not limited to **physical assault, theft, kidnapping, or emotional harm**.
  • Liability Waiver: To the maximum extent permitted by law, you hereby **RELEASE AND DISCHARGE** Rosecoco Africa from any claims, demands, or damages arising out of or in any way connected with your offline interactions with other users.

06 INTELLECTUAL PROPERTY (IP)

  • License Grant: You retain ownership of your content, but you grant Rosecoco Africa a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Platform.
  • Copyright Infringement (DMCA): We respect IP rights. If you believe your work has been copied in a way that constitutes copyright infringement, please submit a detailed notice to our legal team.

07 LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROSECOCO AFRICA, ITS OWNERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

User Safety: We do not conduct background checks on all users. Your safety is your responsibility. The Platform is not liable for any physical harm, financial loss, or emotional distress resulting from interactions initiated via the Platform.

08 INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rosecoco Africa and its owners from and against any and all claims, damages, liabilities, and expenses (including legal fees) arising out of your breach of these Terms, your use of the Platform, or your violation of any third-party rights (including privacy and likeness rights).

09 DATA PROTECTION (DPA/POPIA)

We handle data in compliance with the **Kenya Data Protection Act 2019** and the **South African Protection of Personal Information Act (POPIA)**. By using the Platform, you consent to the processing of your data as outlined in our Privacy Policy.
